Pick Up Your (Proverbial) Pens: Proposed DOL Overtime Rule Now Officially Open for Comment

When ANCOR reported on the Department of Labor’s (DOL) Overtime Rule earlier this month, the proposed rule had been officially announced. The proposed Overtime Rule is now published in the Federal Register, and the system receiving public comments is now open. The deadline for comments is May 21, 2019.

ANCOR has been following this issue closely because disability supports operate in a unique fiscal environment. In 2015 the drafting of this rule sparked ANCOR’s Save our Services (SOS) campaign.. While providers of supports for people with disabilities generally support higher wages for their staff because of a workforce crisis affecting the stability of supports, they operate under restraints because they depend primarily on Medicaid funding to pay wages. Disability supports receive fixed, non-negotiable Medicaid funding rates that vary from state to state because of the federal-state partnership nature of Medicaid. Because of these exceptional circumstances, ANCOR will be submitting comments on the rule.
