OSHA Withdraws Vaccine or Test Rule

On January 26, the Occupational Safety and Health Administration (OSHA) published a notice in the federal register withdrawing its Vaccination and Testing Emergency Temporary Standard (ETS). After the U.S. Supreme Court’s 6-3 decision preventing enforcement of the Vaccination and Testing ETS, the ETS was set for further consideration through the U.S. Court of Appeals for the Sixth Circuit. The DOL’s decision to withdraw the rule was made with recognition that the Sixth Circuit was unlikely to reach a different result.
