Supreme Court Hears Oral Arguments in Medicaid Rate Case

Supreme Court Hears Oral Arguments in Medicaid Rate Case

On Tuesday, the Supreme Court heard arguments in the case Armstrong v. Exceptional Child Center, Inc. (Docket No. 14-15). ANCOR joined with several other national organizations to file an amicus curae brief in the case. (For background on the case and the amicus brief, see WICs article, "ANCOR Files Amicus Brief in Supreme Court Medicaid Rate Case," January 12, 2015.) The case has the potential to significantly impact state Medicaid programs nationwide if the Court rules that private providers have legal standing to hold states accountable for setting adequate Medicaid rates. 

Barbara Merrill and Esme Grant of ANCOR attended the oral arguments on Tuesday. The justices asked many relevant questions of the attorneys arguing before them, with several questions indicating a deep understanding of the issue from several members of the court. A decision will likely be issued in the spring. ANCOR will continue to follow the case closely and report on the holding when it is published.
