New Litigation Resource Available to ANCOR Members

The ANCOR Government Relations Committee is pleased to announce a new information resource for members: the Disability Law Library and Resource Center (DLLRC), which is located on the ANCOR Connected Community.

ANCOR recognizes that its members derive significant benefit from receiving timely information about legal developments around the country, and this library is intended to share and file that information in an easy-to-access format, both for locating relevant cases and related materials, as well as to encourage members to share legal developments.

The DLLRC will include information about federal and state legal developments across the country. Although the primary focus will be Olmstead/ADA enforcement actions and provider rate challenges, we anticipate inclusion of a broader range of significant cases, including cases involving audit/fraud and abuse, zoning, employment, and Centers for Medicare & Medicaid Services’ review of Medicaid state plans and amendments.

ANCOR will not be providing any legal advice through this resource; the DLLRC is intended to provide members with the resources that, in some instances, may lead to a litigation strategy or inform a legislative initiative intended to prevent the need for a lawsuit.

Consistent with the Government Relation Committee’s 2012 priorities, the DLLRC will:

  • Assist providers to support efforts to meet the integration mandate of the Olmstead decision;
  • Identify court cases of national significance;
  • Engage ANCOR members in providing information on pending federal and state legal actions; and
  • Provide an online forum for members on significant court actions that affect providers and beneficiaries.
