Judge Declines to Stay Injunction in Overtime Rule Case

On January 3, a federal judge in Texas declined to lift the injunction against the Department of Labor (DOL) Overtime Rule as requested by the DOL. (See WICs article, “Federal Court Grants Injunction for DOL Overtime Rule, Suspends Compliance Deadline,” November 23, 2016.) 

In late November, just before the rule was to go into effect, a federal district court judge ordered an injunction against the rule. The DOL appealed the decision, and requested that the court lift the injunction pending that appeal. However, the judge in the case determined that the injunction should remain in place. 

The overtime rule is likely to be rolled back or left unenforced by the new administration. ANCOR will continue to monitor the litigation and provide relevant updates to members.
