HHS Issues Proposed Rule on Essential Health Benefits

The U.S. Department of Health and Human Services (HHS) has issued a proposed rule that would facilitate implementation of aspects of the Patient Protection and Affordable Care Act that direct the department to define essential health benefits.

The regulation would require plans to provide information sufficient to determine which benefits will be included in the essential health benefits benchmark. Additionally, the rule proposes that certain plan issuers submit certain benefit and enrollment information to HHS so that HHS may define, evaluate and provide the essential health benefits. HHS further proposes that enrollment data submitted to HealthCare.gov would be the source of product enrollment.

HHS is currently soliciting comments on the proposed rule.
