On July 8, the National Association of Medicaid Directors (NAMD) reported that the Department of Labor responded to its letter requesting the extension of the implementation period for the DOL's new rule which amended the Fair Labor Standards Act (FLSA). The carefully worded DOL response to NAMD does not specifically decline the delay request, which may indicate the department is still considering the request from stakeholders.In the response, DOL's Wage and Hour Deputy Administrator Laura Fortman wrote that the final rule is scheduled to take effect January 1, 2015. She goes on to state that, "Should the Department determine that it is in the best interest of both consumers and workers to extend the effective date, we will notify the regulated community through a notice in the Federal Register."
