CMS Finalizes 1115 Medicaid Waiver

ANCOR is pleased to learn that the Centers for Medicare and Medicaid Services will publish its long-awaited Medicaid 1115 demonstration waiver regulation implementing an Affordable Care Actrequirement to improve the transparency of the review and approval process in the Federal Register on Monday, February 27.

The final regulation is designed to ensure public input, at both federal and state levels in the development, review, approval, and extension of Medicaid and CHIP demonstrations under section 1115 of the Social Security Act as factors in CMS’ decision-making.The new requirements will also apply to eligible Medicare-Medicaid financial and delivery system arrangements (“duals” initiatives).

The final rule will be effective April 27, 2012.

ANCOR will distribute an issue brief on the new rule’s requirements for members early next week so that providers can begin holding states accountable for open and transparent processes.
