ANCOR Defends Rights of Medicaid Beneficiaries in Supreme Court Case

August 12, 2011

ANCOR is among 20 national organizations that joined in filing a “friend-of-the-court” brief in Douglas v. Independent Living Center of Southern California—the lead case in a series of lawsuits triggered when the California legislature attempted to severely limit the rates the state would pay Medicaid-participating providers.

The U.S. Supreme Court will determine whether providers and beneficiaries have “standing” in federal courts to bring lawsuits against state Medicaid officials who are reducing Medicaid payments beyond the limits permitted by federal law.An unfavorable decision by the court would have devastating ripple effects when the legal standard is applied to other areas where providers and participants want to enforce Medicaid law against a state.

ANCOR thanks AARP and the National Health Law Program for co-counseling the filing of the amicus brief.
